Am I Eligible to Make a Bicycle Accident Claim?

You may be eligible for bicycle accident compensation if you’ve been knocked off your bike on the road, park or shared pathway—whether from a vehicle or not. You can also claim compensation if someone you were dependent on dies in a bicycle accident involving a motor vehicle. Most cycling accidents occur when other drivers cut you off or rear-end your bike due to reckless speeding.

At Wyatts, our professional bicycle accident lawyers will get you maximum compensation for your injuries and the distress they’ve caused to your life. We’ve helped clients get compensated for many bicycle accidents, including:

  • A driver failing to give way, usually when they pull out of an intersection and hit the cyclist
  • A car hits the cyclist when they speed past or pass too close
  • Being hit from behind at speed resulting in serious injuries
  • Getting hit by a car door when passing by (dooring)

What if I’m Injured in a Hit-and-Run?

If you’ve been involved in a hit-and-run in NSW where the driver fled the scene and can’t be identified, you may still be able to claim compensation for your injuries. Under the NSW Compulsory Third Party (CTP) insurance scheme, you can lodge a claim with the ‘Nominal Defendant,’ a special fund to assist victims when the at-fault driver is unknown or untraceable.

What Compensation Can I Claim for a Bicycle Accident?

Your compensation will depend on the severity of your injuries, the state where the bicycle accident occurred, and the accident’s financial impact. Navigating these processes can be challenging, but our team of experienced bicycle accident lawyers is here to simplify the entire process.

You may be able to claim for:

  • Medical expenses, including surgeries, hospital stays, post-acute support, rehabilitation, and ongoing treatments
  • Loss of past and future income under the CTP scheme
  • Disability support (if applicable)
  • Nursing services Home and vehicle modifications
  • Pain and suffering, including psychological distress, under the CTP scheme
  • Ongoing care or support services, such as in-home assistance
  • Costs associated with retraining for your job
  • Legal costs for submitting a claim

The compensation you’re entitled to depends on the severity of your injuries—classified as ‘threshold’ (minor) or ‘above threshold’—and where the bicycle accident happened. Here is a classification of injuries:

Physical Injury Classification Examples

Threshold Minor (soft tissue injuries)

  • Muscle strain without tears
  • Sore back
  • Whiplash

Above threshold (fractures, organ damage)

what-can-you-claim

  • Broken arm
  • Head or brain injury
  • Injuries requiring surgery

Your bicycle accident compensation will also depend on the extent of your losses. Here’s a breakdown of the entitlements:

Category of Injury Your Entitlements

Minor injury

Income support, medical, and home care expenses for up to 12 months

Above threshold

Income support, medical, and home care expenses can extend beyond 12 months if there is a claim for damages. A lump sum for past and future lost income.

Non-threshold injury over 10% permanent impairment

An additional lump sum for pain and suffering.

Can I Claim For Damage To My Bike?

The NSW CTP scheme only covers personal injuries, not property damage. If your bike is damaged, you’ll need to look elsewhere. If you have bicycle insurance or your bike is covered under your home contents insurance, you can claim through those policies. Otherwise, you’ll need to claim directly from the at-fault driver.

To do this, get a repair or replacement quote for your bike, then send the at-fault driver a letter of demand outlining the costs. If they refuse to pay, you can escalate the matter by filing a claim in the local court. For most bike damage claims, the matter will be resolved by the small claims division of the court.

How Much Compensation Can I Expect from a Bicycle Accident Claim?

The amount of compensation you’ll get from a bicycle accident will depend on the severity of your injuries, the state where the accident occurred and the road accident law you’re covered by. The amount you’ll receive will vary depending on your circumstances. You may get a percentage of your weekly earnings plus all medical expenses. In the case of permanent disability or injury, you may also be eligible for a lump sum.

According to the State Insurance Regulatory Authority (SIRA), $1.5 billion was paid in motor vehicle accident compensation, including benefits and lump sums, for 12,000 injury claims reported in the 12 months to October 2025 to NSW. That’s $125,000 per claim.

How Do I Claim Bicycle Injury Compensation in NSW?

If you got injured in a bicycle accident while working, you can lodge your CTP claim by:

  1. Getting a police event number by calling 131 444 or visiting a police station
  2. Getting a fitness certificate from your doctor
  3. Lodging an application for personal injury benefits on the vehicle’s CTP insurer at fault for the accident within 28 days. The final deadline for a CTP claim is 3 months from the accident’s date. Remember this application doesn’t include lump sum payments; you need to apply for those separately. A bicycle accident lawyer will advise you based on your circumstances so you can navigate the claim process and get your entitlements. Contact Wyatts at 1800 773 880.

How Long After a Bicycle Accident Can I Make a Claim?

The time to lodge a bicycle accident claim varies from state to state and territory to territory. In some places you must lodge your claim within 28 days of the accident to get income loss benefits from the accident date. In other places like Queensland, you may have 3 months or 12 months to claim. You may also need to explain any delays.

Your Rights and Entitlements for a Bicycle Accident Claim

Under Australian motor vehicle accident law, your entitlements will depend on the degree of your fault, the extent of your injuries, where the accident occurred, and whether the injuries meet the legal thresholds for compensation. You may also be eligible for certain benefits under the Compulsory Third Party (CTP) insurance scheme.

If you were at fault, you can claim personal injury compensation for up to 12 months. If you were not at fault, your benefits may last for 24 months or more, and you may also be eligible for a lump sum.

Also, the specifics of your injuries play a big part. The law defines a “threshold,” which measures your ability to fully recover from your injuries with appropriate treatment and get back to your normal life, work and activities on time.

Up to the injury “threshold”

Income support, medical, and home care expenses for up to 12 months

Above the injury “threshold”

Income support, medical, and home care expenses can extend beyond 12 months if there is a claim for damages. A lump sum for past and future lost income

Above the injury “threshold,” plus over 10% permanent impairment

An additional lump sum for pain and suffering

Key Legal Note: Your entitlements are state-based, and legal thresholds and time limits apply. We ensure your claim meets all legal requirements.

Our motor vehicle compensation specialists at Wyatts can make sure all of your injuries are considered and help you prepare your claim so you get everything you’re entitled to.
