Am I Eligible for CTP Compensation After a Truck Accident?
If you were injured in a truck accident, you may be eligible for the Compulsory Third Party (CTP) compensation as well as workers compensation claim. You’re eligible for these payments if you sustain:
- Injuries from road traffic accidents include collisions, rollovers, and accidents caused by fatigue from long shifts.
- Wear and tear injuries resulting in severe neck and back distress
- Musculoskeletal injuries caused by overexertion during truck unloading
- Injuries from tripping or falling from the truck while working
If you were at fault, you could claim for initial medical costs and lost income within the first 12 months. Severe injuries may qualify you for additional care under the icare Lifetime Care scheme. Contact us to confirm your eligibility.
How Long After a Truck Accident Can I Make a Claim?
The time to lodge a truck accident claim varies from state to state and territory to territory. In New South Wales, you must lodge your claim within 28 days of the accident to get income loss benefits from the accident date. In other places, such as Queensland, you may have 3 months or 12 months to claim. You may also need to explain any delays.
How Long Will a Truck Accident Claim Take?
A typical truck accident claim takes about 1-3 years to complete, depending on the duration of your recovery and if the insurer accepts fault. At Wyatts Lawyers, our truck accident injury lawyers will help you resolve the compensation matter quickly. We will assess your situation and give you a realistic estimation of how long the claim may take.
How Do No Win No Fee Lawyers Work?
Wyatts operates on a No Win, No Fee basis, meaning you won’t pay legal fees unless your case is successful. This allows you to pursue your claim without financial risk. Always check what is covered under the No Win, No Fee agreement to avoid unexpected costs.
What Will A Truck Accident Lawyer Cost Me?
At Wyatts, we work on a No Win, No Fee basis, but you can also get your legal fees paid by the insurer. For CTP claims, if your claim exceeds $75,000, the insurer will cover a portion of your legal fees. For claims at or below $75,000, the insurer will pay all of your legal costs.
In the case of workers’ compensation claims, we can request funding from the Independent Review Office (IRO) on your behalf to cover our fees, meaning you won’t have any out-of-pocket expenses.
When seeking a lump sum from the CTP insurer for claims up to $75,000, there is a schedule of regulated fees that outlines what a lawyer can charge for their assistance. The insurer covers these fees.
If your settlement exceeds $75,000, the insurer will also pay your legal fees. We will provide you with a detailed schedule of these fees as part of a “costs agreement,” which specifically pertains to the charges for your claim above the $75,000 threshold.
It’s important to note that the regulated fees still apply to the services we provide for the initial $75,000 of your claim and will be paid by the insurer.
