WHAT YOU NEED TO KNOW ABOUT FARMING INJURIES

Farming is one of the most physically demanding industries, with risks ranging from machinery accidents and animal-related injuries to chemical exposure and repetitive strain injuries. If you’ve been injured while working on a farm, you may be entitled to compensation. Here’s what you need to know about making a claim.

You may be eligible for a farming injury claim if you’ve been injured or fallen severely ill as part of your work. You can also submit a compensation claim if you have a pre-existing injury and your work responsibilities make it worse.

Workers who can claim for farming compensation include:

  • Full-time workers
  • Part-time workers
  • Casual employees
  • Sub-contractors/Sole traders

At Wyatts, our professional work injury lawyers will ensure you get maximum compensation for your injuries and distress.

Some common injuries that occur on farms that are eligible for compensation include:

  • Tractor Accidents – Injuries from rolling tractors or colliding with other objects, resulting in fractures, amputations or serious trauma.
  • Falls from Height – Falls from roofs, ladders or structures, often resulting in serious injuries.
  • Back and Neck Injuries – Sprains, strains and torn ligaments from repetitive tasks and heavy lifting.
  • Farm Machinery Accidents – Injuries from operating equipment like chainsaws, harvesters, spreaders and seeders.
  • Animal-Related Injuries – Injuries from being kicked, knocked down or pinned by livestock, including horse riding accidents.
  • Chemical Exposure – Pesticides and farm chemicals can cause respiratory issues, skin irritation and long-term health effects.

Regardless of how you have been injured, our experienced work injury lawyers can help you navigate your farming injury compensation claim. Contact us today to receive the compensation you’re entitled to.

Your compensation will depend on the severity of your injuries, when they occurred, your state, and the law you’re covered by. Navigating these processes can be challenging, but our team of professional farming accident lawyers is here to simplify the entire process.

You may be able to claim for most expenses related to your injury, such as:

  • Medical, hospital, and nursing care
  • Personal, household, and occupational support
  • Doctor and pharmacy costs
  • Physiotherapy and chiropractic treatment
  • Rehabilitation services
  • Ambulance transportation

Depending on your situation, additional benefits may be approved, such as:

  • Attendant care services
  • Home or vehicle modifications
  • Domestic assistance
  • Transportation expenses

Our experienced workers compensation lawyers can guide you through the claims process and ensure you receive all the benefits you’re entitled to. Contact Wyatts Lawyers at 1800 773 880 to get your free claim check.

The amount you can claim depends on the severity of your injuries, their causes, and the location. Here’s a breakdown of potential entitlements:

Types of Payout Benefits
Workers Compensation Payment
  • Weekly payments to cover lost income while you’re unable to work.
  • Medical expenses for healthcare, rehabilitation, and travel costs.
  • Permanent impairment payout if your whole person impairment (WPI) is above a certain threshold.
  • Work injury damages (WID) payout – a lump sum for injuries caused by employer negligence.
Total & Permanent Disability (TPD) Claims
  • If your injury is severe and prevents you from returning to work, you may be eligible for a TPD lump sum payout through your super fund.
  • No fixed list of injuries qualifies—eligibility depends on your policy and how the injury impacts your ability to work.
Public Liability Payouts
  • If your injury occurred due to unsafe conditions at a third-party site (not directly your employer’s fault), you may have a public liability claim against the site owner.
  • Covers damages beyond workers compensation, including pain and suffering and economic losses.

If you’re unsure about your entitlements, our expert farming work injury lawyers can assess your case and guide you through the claims process.

To lodge your workplace compensation claim, you need to gather the necessary information and documents beforehand. Here’s what you need to do:

  1. Inform your employer as soon as possible.
  2. Get a Medical Certificate, also known as a WorkCover medical certificate, from your regular doctor.
  3. Lodge a Worker’s Injury Claim Form, which you can get from your employer or your workers compensation insurer, or we can provide it for you upon request.
  4. Keep a copy of the claim form and medical certificate before submitting the originals to your employer or workers compensation insurer.

By preparing these key documents, you will help the claims process run smoothly. If you need help, our workers compensation experts are here to guide you every step of the way. Contact Wyatts at 1800 773 880.

No, your employer can’t fire you within the first six months of your injury just because you’re not fit for work. For example, if you live in NSW, your employer can only fire you after six months if they’ve met all their obligations to you. However, under the NSW Workers Compensation Act, you’re still entitled to benefits, and there may be options for you to go back to your job.

Yes, casual workers can claim workers compensation if injured at work. Workers compensation is not limited to citizens or permanent residents. If you’re on a work visa, you can still claim if you’re injured while working in Australia.
