Am I Eligible to Make a Toxic Chemical Injury Claim?

Toxic chemical injuries occur when workers are exposed to hazardous substances in the workplace and develop serious health conditions. You may be eligible for a claim if you have developed diseases like lung cancer or mesothelioma because of inhaling or ingesting toxic particles at your workplace or as part of your work.

You can also make a toxic chemical injury claim if your toxic chemical exposure:

  • Happened during home renovations
  • Was unknown to you at the time
  • Was over 50 years ago or in another state or country

Toxic chemical-related diseases may not show symptoms immediately, but you may start to discover them a few years later. Some professions or industries where toxic chemical-related diseases are common include:

The amount you can claim depends on your Whole Person Impairment (WPI) assessment and other legal factors. If your impairment is assessed at 11% or higher you may be eligible for a lump sum payment in addition to weekly payments.

Here’s a breakdown of potential entitlements:

Types of Payment Benefits
